Terms and Conditions

Please read these terms and conditions of use carefully before accessing, using or obtaining any materials, information, products or services. By accessing, the A to Z Medical website, mobile or tablet application, or any other feature or other A to Z Medical platform (collectively “Our Website”) and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the Terms and Conditions set out below (including the privacy statement).

We may modify these Terms, for any reason at any time, by posting a new version on Our Website; these changes do not affect rights and obligations that arose prior to such changes. Your continued use of Our Website following the posting of modified Terms will be subject to the Terms in effect at the time of your use. Please review these Terms periodically for changes. If you object to any provision of these Terms or any subsequent modifications to these Terms or become dissatisfied with Our Website in any way, your only recourse is to immediately terminate use of Our Website.

Definitions:

"atozwheelchairs.com," "us," "we" or "our" means A to Z Medical Equipment and Supplies, a limited liability company incorporated under the laws of the United States, and having its registered address at 15060 E. Beltwood Parkway, Addison, Texas 75001.

"Platform" means the (mobile/desktop) website and app on which the Service is made available owned, controlled, managed, maintained and/or hosted by Atozwheelchairs.com.

"Service" means the online reservation service (including the facilitation of payments) of various products and services as from time to time made available by A to Z Medical Equipment and Supplies on the Platform.

"Supplier" means the provider of equipment (e.g. Power Wheelchair, Lift Chair, Walker, & Cane), rental equipment, and any other medical or related product or service as from time to time available for reservation/purchase on the Platform.

1. Scope of Our Service

Through the Platform, we (atozwheelchairs.com A to Z Medical Equipment and Supplies and its affiliate (distribution) partners) provide an online platform through which customers/visitors can find products and services for reservation and purchase. By making a reservation and/or purchase through Atozwheelchairs.com, you enter into a direct (legally binding) contractual relationship with Us with which you make a reservation or purchase a product or service (as applicable). From the point at which you make your reservation and/or purchase, we act solely as an intermediary between you and the Supplier, transmitting the details of your reservation to the relevant Supplier(s) and sending you a confirmation email for and on behalf of the Supplier.

2. Copyright, Trademarks, and Intellectual Property

All content included in or made available through any A to Z Medical Equipment and Supplies Service, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of A to Z Medical Equipment and Supplies or its content suppliers and protected by United States and international copyright laws. The compilation of all content included in or made available through any A to Z Medical Equipment and Supplies Service is the exclusive property of A to Z Medical Equipment and Supplies and protected by U.S. and international copyright laws.
Graphics, logos, page headers, button icons, scripts, and service names included in or made available through any A to Z Medical Equipment and Supplies Service are trademarks or trade dress of A TO Z MEDICAL EQUIPMENT AND SUPPLY in the U.S. and other countries. A TO Z MEDICAL EQUIPMENT AND SUPPLY's trademarks and trade dress may not be used in connection with any product or service that is not A TO Z MEDICAL EQUIPMENT AND SUPPLY's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits A TO Z MEDICAL EQUIPMENT AND SUPPLY. All other trademarks not owned by A TO Z MEDICAL EQUIPMENT AND SUPPLY that appear in any A TO Z MEDICAL EQUIPMENT AND SUPPLY Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by A TO Z MEDICAL EQUIPMENT AND SUPPLY.

3. YOUR ACCOUNT

You may need your own A TO Z MEDICAL EQUIPMENT AND SUPPLY account to use certain A TO Z MEDICAL EQUIPMENT AND SUPPLY Services, and you may be required to be logged in to the account and have a valid payment method associated with it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. A TO Z MEDICAL EQUIPMENT AND SUPPLY does sell products for children, but it sells them to adults, who can purchase with a credit card or other permitted payment method. If you are under 18, you may use the A TO Z MEDICAL EQUIPMENT AND SUPPLY Services only with involvement of a parent or guardian. A TO Z MEDICAL EQUIPMENT AND SUPPLY reserves the right to refuse service, terminate accounts, terminate your rights to use A TO Z MEDICAL EQUIPMENT AND SUPPLY Services, remove or edit content, or cancel orders in its sole discretion.

4. PRICING & PRODUCT DESCRIPTIONS

A TO Z MEDICAL EQUIPMENT AND SUPPLY attempts to be as accurate as possible. However, A TO Z MEDICAL EQUIPMENT AND SUPPLY does not warrant that product descriptions or other content of any A TO Z MEDICAL EQUIPMENT AND SUPPLY Service is accurate, complete, reliable, current, or error-free. If a product offered by A TO Z MEDICAL EQUIPMENT AND SUPPLY itself is not as described, your sole remedy is to return it in unused condition.
- "List Price" means the suggested retail price of a product as provided by a manufacturer, supplier, or seller. We regularly check List Prices against prices recently found on A TO Z MEDICAL EQUIPMENT AND SUPPLY and other retailers. Certain products may have a "Was Price" displayed, which is determined using recent price history of the product on A TO Z MEDICAL EQUIPMENT AND SUPPLY.
- With respect to items sold by A TO Z MEDICAL EQUIPMENT AND SUPPLY, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If the correct price of an item sold by A TO Z MEDICAL EQUIPMENT AND SUPPLY is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.
- We generally do not charge your credit card until after your order has entered the shipping process.

5. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICES ARE PROVIDED BY A TO Z MEDICAL EQUIPMENT AND SUPPLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. A TO Z MEDICAL EQUIPMENT AND SUPPLY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICES IS AT YOUR SOLE RISK.
TO THE FULL EXTENT PERMISSIBLE BY LAW, A TO Z MEDICAL EQUIPMENT AND SUPPLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. A TO Z MEDICAL EQUIPMENT AND SUPPLY DOES NOT WARRANT THAT THE A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICES, A TO Z MEDICAL EQUIPMENT AND SUPPLY 'S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM A TO Z MEDICAL EQUIPMENT AND SUPPLY ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TO THE FULL EXTENT PERMISSIBLE BY LAW, A TO Z MEDICAL EQUIPMENT AND SUPPLY WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY A TO Z MEDICAL EQUIPMENT AND SUPPLY SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

6. ADVANCED BENEFICIARY NOTICE OF NON-COVERAGE (ABN)

SUPPLIER / NOTIFIER: A TO Z MEDICAL EQUIPMENT AND SUPPLIES

If Medicare, Medicaid, or any other Private Insurance Company (eg: Blue Cross Blue Shield, Molina, etc.) does not pay for the item or supplies you have ordered, you may have to pay. Medicare does not pay for everything, even some care items that you or your health care provider have good reason to think you need. By agreeing to our Terms and Conditions you are acknowledging that you, the customer, will be liable for any payments not met by your insurance company. We expect Medicare, Medicaid, or any other Private Insurance Company (eg: Blue Cross Blue Shield, Molina, etc.) to not cover any order paid for privately online or in-store. This ABN is to meant to inform the consumer before making a purchase and bypassing their insurance company's pre-authorization or other method of getting their Medical Equipment covered.

Option 1: (This option is selected by default once you’ve agreed to our Terms and Conditions) You (receipient of the equipment) would like to pay for the item now, but do not bill Medicare or any other insurance company for an official decision on payment. You cannot appeal if Medicare is not billed.

Option 2: If you would like to pay for the item now, but bill Medicare or any other insurance company on my behalf for an official decision on payment. To select this option then please submit your request to us via email at orders@atozwheelchairs.com and we will attempt to bill your insurance company on your belalf and we will provide a Medicare Summary Notice (MSN) to you. You understand that if Medicare or other insurance company does not pay, you are responsible for payment, but you can appeal to Medicare by following the directions on the MSN. If Medicare does pay, all payments will be refunded, less co-pays or deductibles.

This notice gives our opinion, not an official Medicare or other insurance decision. If you have other questions on this notice or Medicare billing, call 1-800-MEDICARE (1-800-633-4227 / TTY: 1-877-486-2048). Agreeing to our Terms and Conditions means you have received and understand this notice. You may also request a copy.

7. A TO Z MEDICAL EQUIPMENT RETURN POLICY
